BENGALURU: The state police department has issued a significant order regarding the registration of FIRs under four specific sections of the Bharatiya Nyaya Sanhita (BNS).
According to the order issued by DG&IGP M A Salim, police officers are now required to obtain permission from their superiors or in commissionerate areas before registering an FIR under Sections 304, 103(2), 111, and 113(B) of the BNS.
The sections in question relate to serious offences including:
– Section 304: It deals with the offence of snatching.
– Section 103(2): Murder committed by a group of five or more people acting in concert on grounds of race, caste, community, sex, place of birth, language, personal belief, or any other similar ground.
– Section 111: Offense of organised crime.
– Section 113(B): Deals with terrorist acts like threatening the unity, integrity, sovereignty, security, or economic security of India.
An investigating officer must obtain approval from his/her superiors before registering an FIR under these Sections. For Sections 304, 103(2), and 111, permission must be obtained from ASP-level officers in district areas and DCP-level officers in commissionerate areas.
For Section 113(B), permission must be obtained from SP-level officers in district areas and DCP-level officers in commissionerate areas. If an order is received orally for urgent work, written approval should be obtained within 24 hours, the communication from the DG&IGP says.
