BENGALURU: The 64th Additional City Civil and Sessions (ACCH) court on Saturday adjourned to August 30 hearing on the petition by the police seeking to shift actor Darshan, along with other accused to jails outside Bengalurru. They were produced before the judge via video conference from jail who directed the jail authorities to produce all the accused again through video conference on September 9.
The police and prison authorities had sougth shifting of actor Darshan and fourr other accused to Ballari jail, citing that the accused should be shifted to the same jail where they were lodged when they applied for bail. The jail authorities cited administrative and security reasons for the transfer.
Only accused Pradosh’s lawyer filed objections. The lawyers for Darshan, Pavithra Gowda and other accused sought some time to file objections. Pavithra Gowda’s lawyer filed a petition seeking statutory bail, arguing that the chargesheet was filed under the wrong section of the law. The chargesheet has been filed under CrPC, but it should have been filed under BNSS, the lawyer argued.
The lawyer, Balan, argued that the chargesheet should have been filed under the Bharatiya Nagarik Suraksha Sanhita (BNSS) but was instead filed under Section 173 of the Criminal Procedure Code (CrPC). Balan stated that since the chargesheet was filed in September, after July 1, 2024, it should have been filed under BNSS. Due to this, Balan requested time.
